Release of Liability and Payment Terms
By signing below I agree to the following:RELEASE OF LIABILITY:
1. I authorize The Help Button, to perform work on my computer. I understand that The Help Button, technicians have been trained to perform computer hardware and software work, but The Help Button, is not an authorized service dealer. Further, I agree to release, indemnify, and hold harmless The Help Button and its employees, from liability for any claims or damages of any kind or description that may arise from any computer work performed on my computer. I understand that The Help Button and its employees, is not responsible for any data loss, which may occur as a result of work done on my computer.
2. I certify that I am the expressed owner of the computer system1 described in this document. In the event that I am found not to be the true expressed owner of this computer system, I assume all liability for any claim made as the result of the technical support rendered by The Help Button and its employees, on this computer system, including those claims which assert negligence on the part of The Help Button.
3. I understand that technical support rendered by The Help Button, may void manufacturer warranties for this computer system. The Help Button, does not assume any liability or warranty in the event that the manufacturer warranties are voided.
4. I understand that The Help Button, offers to render its services free of charge if the problem is not solved, regarding the success of this technical support.
5. I expressly waive all claims against The Help Button, for any damages to this computer system or data that are incidental to the technical support rendered by The Help Button.
6. I understand that computer systems or accessories not paid for and picked up within 30 days of invoice will become the property of The Help Button.
The liability of The Help Button, is strictly limited to those damages to this computer system or data that are due to negligence on the part of The Help Button, while technical support is being rendered.
7. Software demand services may be offered to you by The Help Button. If you elect to receive software demand services, you are electing to purchase software downloads. In such event, The Help Button will refer you to a third party who will provide you with information about the software and who will collect your payment information and or The Help Button can purchase the software and attach it to clients bill with approval of client. The Help Button transfers you, at your request, to the third party for your convenience; however, The Help Button does not warrant or make any representation about the services or software provided by the third party. Ask about the third party's privacy policy as it is different from the privacy policy that applies to The Help Button collection and use of your personal information. Also ask about the service and software warranty applicable to the software download you receive from the third party as that warranty differs from The Help Button's service warranty.
PAYMENT TERMS:
I acknowledge that I requested The Help Button services. I understand that once a technician is on site or items or checked in that the $50 an hour fee is applicable, and starts once technician is on site. If 15 minutes has passed into following hour customer is liable for full hour of labor. The Help Button does not provide billing service to clients unless under maintenance contract. Clients agree to pay The Help Button for all charges at time of pickup or before technician leaves site. If paying by credit card through Paypal there is a 3.50 charge for processing. Along with if paying by check a 50.00 processing fee will be added to bill if check bounces (insufficient funds). The Help Button does not offer or provide telephone technical support for client, but does offer a contact number for clients without internet access to schedule appointments. Neither the signing of this agreement nor the performance of services by The Help Button implies availability of telephone technical support or of future technical services. This document constitutes the entire agreement between CLIENT and The Help Button. No other agreement, verbal or otherwise shall be in effect except if agreed to in writing and signed by both parties.
